Any person that’s diagnosed as having mesothelioma and has previously worked someplace where they have been subject to asbestos exposure should consider obtaining legal advice to see whether they can bring a civil law personal injury claim for mesothelioma compensation from their employer.

As mesothelioma claims can be a very specialised area, when getting in touch with compensation lawyers or a mesothelioma law firm it is always a good idea to ask:

When making a mesothelioma claim does the attorney specialise in asbestos cases and asbestos claims. Are they fully conversant with asbestos law and specifically mesothelioma law and mesothelioma litigation?

How many mesothelioma compensation cases has the attorney dealt with?

Exactly how many of these mesothelioma claims have actually come to court? (Often cases are settled out of court which may be preferable to you)

How many asbestos claims has the attorney successfully handled in the past three years?

Would you be expected to pay the mesothelioma lawyers ? Or will they work on a no-win/no-fee basis? This tends to be the norm and it is highly recommended that you get an attorney that will work on this basis. Find out how they get paid for acting for you.

In the case of the mesothelioma compensation are there any additional expenses you may be expected to pay, such as court costs and court fees?

How will you be kept informed on what exactly is happening with your claim for mesothelioma compensation ?

Just how long will the mesothelioma claims process take?

How soon does the attorney expect to start a court action?

For the mesothelioma compensation claim to be successful you would have to show that:

It’s likely that your mesothelioma compensation claim is due to exposure to asbestos during the duration of your work. This might be hard to prove, so the legal phrase is that ‘on the balance of probabilities’ the asbestos exposure caused the condition. Which means although it cannot be certain that the mesothelioma was a result of one or more jobs, it is more likely than not that it was.

And

Your employer at the time was careless (negligent) in not keeping up the standards required by common law.

It may be possible to sue your employer for specific offences against health and safety regulations.

If a previous employer has gone out of business it may be possible to make a mesothelioma compensation claim against the firm’s insurers.

As you can see there is quite a lot to consider when making a claim for mesothelioma compensation BUT if you ask the right questions you should have no problems.

If a relative or close friend has asbestosis, mesothelioma or another asbestos-related disease it is a awful thing. It’s small consolation but the person who has the disease or alternatively in the case of another person already having passed away, the family of the deceased, can claim compensation. Many asbestos claims have been settled out of court.

The money can certainly help to pay off considerations such as medical bills, psychiatric help and compensate for loss of earnings, disability along with damages.

Carry out these simple steps to help get compensation when making asbestos claims.:

1. To be able to file a claim for asbestos compensation, you should already be diagnosed with mesothelioma or another asbestos-related disease such as asbestosis.

2. There can be a time limit on the amount of time one has to seek compensation. You ought to clarify your states “statute of limitations” on filing for asbestos compensation. Various states only permit a few years after being diagnosed to file an asbestos claim. If you are past your states limit then all is not lost. Talk to a professional mesothelioma attorney

3. The next thing is to locate an attorney that has experience working with asbestos claims for compensation. You’ll be able to look for an experienced asbestos lawyer at the bar associations, in the Yellow Pages, on the Internet, through word-of-mouth referrals, etc.

4. Once you speak or meet a lawyer make certain they’re experienced with asbestos compensation. Check the amount of associated cases they have worked on, and discover how many they have won.

5. Your attorney will be able to provide you with different options for seeking asbestos compensation. Your attorney might negotiate your case out of court or your case may go to trial.

Keep in mind many of the Companies that exposed their employees to the dangers of asbestos understood exactly what they were doing. They knew the dangers. It’s not only your right to make asbestos claims, you should do it to demonstrate that Companies like this can’t get away with it and have to be punished.

Things You Require To Know" title="Thinking about Filing Mesothelioma Claim ? Things You Require To Know" />

The claim form and each statement of case need to be marked with the title ‘Living Mesothelioma Claim’ or ‘Fatal Mesothelioma Claim’ as applicable.

Any kind of witness statement about liability must identify as far as may be possible -

1. The alleged victim’s history of employment and background of exposure to asbestos;

2. The identity of any workplace where exposure to asbestos of the alleged victim is alleged;

3. Particulars of any self employment in which the alleged victim may have been exposed; and

4, Details of claims made and payments obtained under the Pneumoconiosis etc. (Workers’ Compensation) Act 1979.

The claimant must attach to the claim form -

1. A work history from H M Revenue and Customs (where available); and

2. Any pre-action letter of claim.

Claimants with severely limited life expectancy

Wherever the claimant thinks the actual claim is extremely urgent then on issue of the claim form, the claimant -

1. Can request in writing that the court file is placed promptly before a judge nominated to manage such cases, and

2, Must explain in writing to the court why the claim is urgent.

Where the court decides that the claim is urgent it will -

Fix the date for the case management conference to take place within a short period of time; and tell the claimant when he must serve the claim form if it has not been served already.

The Show Cause Procedure

The show cause procedure is normally on a ‘costs in the case’ basis, for the defendant to identify the evidence and legal arguments that give the defendant a genuine prospect of success on any issues of liability. The court will use this kind of process of the resolution of any mesothelioma claim.

The defendant should be prepared to show why -

(1) a judgment on liability should not be entered against the defendant; and

(2) a standard interim payment on account of damages and (if appropriate) costs and disbursements shouldn’t be made by the defendant by a specified date.

With the first show cause conference if liability remains an issue the court will typically order that the defendant show cause within a further given period.

The order requiring the defendant to show cause within a further given period will direct -

(1) that the defendant file and serve on the claimant by a specified date outline submissions showing cause and -

(a) if the outline submissions aren’t filed and served by a particular date, judgment, for a sum to be determined by the court, will be entered against the defendant without the need for any further order and the defendant will be ordered to make a standard interim payment by a specific date; or

(b) if the outline submissions are filed and served by the specified date, the claim will be listed for a show cause hearing; or

(2) that the defendant show cause at a hearing on a date fixed by the court.

At the first case management conference the court will -

(1) fix the date or trial window for the determination of damages and give any other directions as appropriate where the defendant admits liability or judgment is entered;

(2) fix the date or trial window for the determination of damages and give any other directions as appropriate where an order to show cause has been made (if the defendant subsequently shows cause then the determination date or trial window may be utilised for the trial of any issue); or

(3) in cases in which there is to be a trial on liability, give directions including the date or window for the trial.

Where the defendant fails to show cause on some issues, the court will normally enter judgment on those issues.

Where the defendant fails to show cause on all issues, the court will enter judgment for a sum to be determined and will typically order that a standard interim payment be made.

Where the defendant succeeds in showing cause on some or all issues, the court will order a trial of those issues.

Setting the trial date

In the case of a living mesothelioma claim the date of the determination of damages or the trial will generally not be more than 16 weeks following service of the claim form.

In a fatal mesothelioma claim the hearing date might be more than 16 weeks following

The link between mesothelioma and asbestos was not established till 1960s. Asbestos is a natural compound mined out of the earth and has been very useful in making a wide range of materials like cement, ship building etc. Its use increased since 1940s and millions of people all over the world were employed in extracting, processing and industrial activities. Since no one suspected any side effects, no precautions, whatsoever, were taken by the employers to protect their workers from inhaling or ingesting its flying fibers.

The workers were not aware of the dangers involved in asbestos and they kept on carrying asbestos particles in their cloths or hair. Thus family members were also exposed to the malicious particles as they went home without having a shower or changing cloths. Thus family members also started getting infected. Later on when the relation between mesothelioma and asbestos was established, many governments banned the indiscriminate use of asbestos. Many restrictions were imposed. But by that time many have already become victims of mesothelioma infection.

Once we inhale asbestos particles through the air, they get accumulated in the protective lining of the lungs and other vital organs. This triggers chemical reactions which result in abnormal and uncontrolled division of mesothelium cells. This continues for a number of years with the result that the infection spreads and cancer symptoms appear.

Asbestos can cause a series of other ailments like the lung cancer, but mesothelioma is the most dangerous of all. Precautionary measures like wearing protective masks, showering and changing cloths etc have made work with asbestos somewhat less risk prone. But mesothelioma cases still appear here and there. Every year at least 3000 people get diagnosed to be carrying this disease in the United States alone and the number around the world must be many times than that. It should also be mentioned here that some countries have no such asbestos laws and people are exposed unscrupulously by greedy employees to asbestos exposure and its aftereffects.

Most of the governments have been sympathetic towards the plight of victims considering the connection between mesothelioma and asbestos. Laws are formulated to help the victims to claim money from the employers which can assist them in the financial crisis occurred due to the disease.

Mesothelioma – it’s an ugly word for an ugly condition. Mesothelioma is a rare cancer, with about 3,000 cases a year reported in the U.S. Although the most common form of Mesothelioma, pleural Mesothelioma, affects the membranes surrounding the lungs, this type of cancer is very different from lung cancer. It is a much rarer and usually far more deadly form of cancer than lung cancer. Also, it is unrelated to smoking; it is caused by exposure to asbestos dust and fibers.

Asbestos, a mineral that was widely used throughout most of the 1900s in nearly every industry, forms long fibers that can be woven or mixed into materials. When asbestos is broken or crushed, the resulting dust and fibers hang in the air and land on surfaces nearby. People who breathe in or swallow asbestos dust are at risk for developing Mesothelioma.

Pleural Mesothelioma begins in the lining around the lungs. It usually begins in the outer membrane of one lung, and may progress to involving both lungs and other organs. The symptoms of pleural Mesothelioma include a dry cough, chest pain and pleural effusion.
Pleural effusion is the collection of fluid between the tissue covering the chest wall and the diaphragm and the tissue covering the lungs. Normally, there is a small amount of fluid in that area to make it easy for your lungs to move when breathing. In a person with Mesothelioma, the cells that usually absorb the excess fluid don’t work right, and the fluid builds up, causing pain, coughing and difficulty breathing.

Some of the symptoms that are commonly associated with pleural Mesothelioma include: persistent coughing; difficulty swallowing; facial swelling; weight loss; fever; rasping; and coughing up blood. Some patients may also experience shortness of breath, whether they are being active or even when they are resting. This can be caused by the thickening of the pleura due to the spread of the tumor. The thicker the pleura gets, the less space the lungs have to function properly, hence breathing begins to be affected. The treatment includes surgery chemotherapy and radiation.

Peritoneal Mesothelioma involves the lining of the abdominal and pelvic cavities, called the peritoneum. In about 10% of Mesothelioma cases, swallowed asbestos fibers cause changes to develop in the peritoneum. The symptoms of peritoneal Mesothelioma include swollen and painful abdomen, high temperature, bowel problems, and problems with urination, nausea and vomiting.

The treatment depends upon a number of factors. The doctor, once a diagnosis has been made, will make a recommendation based upon details such as: the extent of the cancer and how advanced it is; the patient’s general condition and health; past medical history of the patient; and the patient’s age.

Pericardial Mesothelioma affects the pericardium – the thin tissue lining around the heart. It’s the rarest of the types of Mesothelioma, accounting for less than 1% of reported cases. The symptoms include chest pain, shortness of breath, persistent coughing and palpitations.

Later-stage symptoms of all types of Mesothelioma include sudden weight loss without any other explanation, spitting up blood and sputum, problems swallowing, and hoarseness

It can occasionally be treated with surgery. However, the nature of this cancer means that it is very advanced by the time that it is diagnosed.

Asbestos can exist in a variety of forms in a building; cement, coatings, floor tiles, insulating, lagging and loose. Many buildings build before 1999 will contain at least one form of asbestos as it was often too expensive or too difficult to extract.

Asbestos cement can come in the form of roofing, cladding and guttering. The most common would be corrugated cement roofing found on warehouses, farm buildings and sometimes sheds and garages. This is considered the safest form of asbestos because the material is held within the concrete but can easily be released if sawed or drilled.

Plenty of ceilings and walls in older buildings were coated in asbestos by either spraying or a textured coating, this existed in lofts, living spaces and around beams. Textured coatings are often quite stable but sprayed coatings have the highest asbestos content so even a small disturbance could release vast quantities into the air.

Tiles made of asbestos were often used in insulating floor surfaces underneath laminate flooring or carpets. Similar forms of the material were used in fire blankets and oven gloves. Although generally quite safe to work with it is still best to consult a specialist or guidelines.

AIB or Asbestos Insulating Board was quite commonly used to insulate lift shafts, roof linings, fire doors and partition walls. Large quantities of this is can still be found in many buildings build before the 1990s and is considered so dangerous only a licensed contractor can work with it.

Many cavities, pipes and boilers are filled and coated with loose fill and lagging asbestos. These are both considered very hazardous and should not be worked with or exposed to anyone other than a trained contractor. Exposure to any of the toxic fibres released can cause damaging respiratory problems and eventually cause a form of cancer known as Mesothelioma.

It has also been steered that laundry the garments of a family member who worked with asbestos will put someone in danger for developing mesothelioma. Not like lung cancer, there is no association between mesothelioma and smoking, but smoking greatly increases the chance of different asbestos-induced cancers.[three] Compensation via asbestos funds or lawsuits is a crucial issue in mesothelioma (see asbestos and also the law).

The symptoms of mesothelioma include shortness of breath because of pleural effusion (fluid between the lung and therefore the chest wall) or chest wall pain, and general symptoms like weight loss. The diagnosis may be suspected with chest X-ray and CT scan, and is confirmed with a biopsy (tissue sample) and microscopic examination. A thoracoscopy (inserting a tube with a camera into the chest) can be used to require biopsies. It allows the introduction of substances like talc to obliterate the pleural area (referred to as pleurodesis), that prevents additional fluid from accumulating and pressing on the lung. Despite treatment with chemotherapy, radiation therapy or generally surgery, the disease carries a poor prognosis. Research concerning screening tests for the early detection of mesothelioma is ongoing.

Signs and symptoms

Symptoms of mesothelioma might not appear till 20 to 50 years once exposure to asbestos. Shortness of breath, cough, and pain in the chest due to an accumulation of fluid in the pleural space are typically symptoms of pleural mesothelioma.

Symptoms of peritoneal mesothelioma embrace weight loss and cachexia, abdominal swelling and pain due to ascites (a buildup of fluid within the abdominal cavity). Other symptoms of Peritoneal Mesothelioma might embody bowel obstruction, blood clotting abnormalities, anemia, and fever. If the cancer has unfold beyond the mesothelium to other components of the body, symptoms may embody pain, bother swallowing, or swelling of the neck or face.

These symptoms might be caused by mesothelioma or by different, less serious conditions.

Mesothelioma that affects the pleura will cause these signs and symptoms:

* Chest wall pain
* Pleural effusion, or fluid surrounding the lung
* Shortness of breath
* Fatigue or anemia
* Wheezing, hoarseness, or cough
* Blood in the sputum (fluid) coughed up (hemoptysis)

In severe cases, the person might have many tumor masses. The individual might develop a pneumothorax, or collapse of the lung. The disease might metastasize, or spread, to alternative parts of the body.

Tumors that have an effect on the abdominal cavity often don’t cause symptoms till they are at a late stage. Symptoms embrace:

* Abdominal pain
* Ascites, or an abnormal buildup of fluid in the abdomen
* A mass in the abdomen
* Issues with bowel operate
* Weight loss

In severe cases of the disease, the following signs and symptoms could be present

* Blood clots within the veins, that might cause thrombophlebitis
* Disseminated intravascular coagulation, a disorder causing severe bleeding in several body organs
* Jaundice, or yellowing of the eyes and skin
* Low blood sugar level
* Pleural effusion
* Pulmonary emboli, or blood clots in the arteries of the lungs
* Severe ascites

In this disease, malevolent cells develop in the mesothelium, a protective lining that covers almost all of the body’s internal organs. Its most common site is the pleura ( outer liner of the lungs and internal chest wall ), but it may also occur in the peritoneum ( the liner of the abdominal cavity ), the heart, the pericardium ( a sac that surrounds the heart ) or tunica vaginalis.

Mesothelioma survival depends on a plethora of factors like the level of advancement of the cancer, the age and health conditions, both physical and mental, of the patient. Experts in mesothelioma treatment and research calculate survival on a five-year scale. Only around ten percent of total patients diagnosed to be under the influence of this cancer reached the five-year target till now.

The probability of mesothelioma survival can be enhanced by continued and rigorous treatment. However, it should be noted that the response to the treatment differs from person to person. The possibility of cure and the length of survival period depend on this response. There are many factors that control the success of treatment. Most importantly, success depends upon the stage of the cancer at the time of diagnosis. Chances of a cure are greater through surgery and chemotherapy in the first and second stages. The chances of survival are bleak in the third and fourth stages.

There are mainly three types of mesothelioma cancer. The first type called pleural mesothelioma affects the membranous covering of the abdomen; the second known as the peritoneal cancer ruins the abdominal cavity and the third one, the pericardial is found in parts in and around the heart. The third one is more malicious than the other two, but it is rarely found. Mesothelioma survival depends on the size of the tumor, the area affected, the level of excess fluid collected in the abdomen or chest, the cell structure, type of cancer cells etc.

Alarming conclusions are reached by the medical community, which has analyzed the mesothelioma survival rates for the last few years. It has found that mesothelioma cancer infection is increasing all around the world. Also it has been found that chemotherapy is successful in cases where surgery is not effective. Researches are tirelessly working on more and more efficient strategies to defeat the fatal asbestos cancer, which has already destroyed the peace and happiness of many families by taking away their near and dear ones. The new treatment techniques invented give a fresh lease of hope for the victims.
