It’s important to note that people suffering with an illness from asbestos exposure seek the advice of an attorney experienced in filing an asbestos suit. The legal world of asbestos and mesothelioma is one set apart from the traditional arena of litigation. The decades of research done on the serious effects of asbestos to human health has become the basis of every mesothelioma prosecutor’s argument. Companies have been brought to their financial knees over asbestos liability, and more and more cases are brought to the courts each year.

Many people decide to pursue a class action lawsuit against multiple companies rather than fight alone. There are also attorneys who specialize in advertising particular mesothelioma cases and encouraging people to contact them if they were involved with a particular business during a certain period of time. These class action asbestos suits can help individuals who need reparations but don’t have the means to hire a lawyer for a lengthy legal battle. An asbestos attorney may also help individuals fight measures that seek to regulatethe amount of money a plaintiff is due in a settlement.

Who Should Pursue A Claim?

Anyone suffering from asbestos exposure can file a claim. It’s most common for the person affected by asbestos to file the claim, but family members are often the ones that file a claim for a victim who died before the case was concluded. Victims often pursue reparations for medical expenses, lost wages, and punitive damages. Family members can attempt to procure monies for funeral costs, medical bills, lost wages, and punitive damages.

Determining the Court and the Litigant

There is a number of courts who could handle an asbestos suit. An experienced lawyer would know whether to file a claim with a state or federal court, or pursue some other means such as a trust fund. Since these cases are so involved, it’s best to work with an attorney from the filing of the claim on through.

Another issue is deciding who the litigants are in the suit. In many cases, there is more than one company to place a claim against. For example, if a factory worker suffered from mesothelioma due to asbestos exposure the claim could be filed against the place of employment, the construction company who was responsible for the construction of the factory, and the company responsible for manufacturing the asbestos materials. It’s the duty of an asbestos attorney to figure out which parties are negligent and the chances that the plaintiff would be awarded a settlement.

Burden of Proof

After a lawyer files a claim, it is the resposibility of the plantiff to furnish proof of asbestos exposure. For a successful lawsuit the plaintiff must prove that the defendant knowingly exposed the plaintiff to asbestos. Proof must be furnished that indicates the amount of medical costs, loss of wages, and all punitive damages caused by an asbestos illness. Many times an attorney may attain a settlement out of court, saving time and money for all parties involved.

Some cases go to court because the defendant refuses to accept blame for the asbestos exposure. Often, class action lawsuits are handled between the two teams of attorneys. Attorneys who specialize in asbestos cases also have to fight against proposed legislation that aims to do away with large asbestos suit settlements and create a fund that pays victims a set amount. Attorneys must argue that victims deserve more reparations for asbestos related illnesses and seek to keep the victims from being affected by controversial legislation.

Mesothelioma is type of cancer which is relatively rare. It and affects about one in a million people. Its usual cause is exposure to asbestos.

The symptoms of this disease are many and varied. They might include breathing difficulties due to build-up of fluid in the lungs, as well as fever, loss of weight and pain in the chest, abdomen or even head and neck. The symptoms might not appear for many decades after the exposure to asbestos. Diagnosis is sometimes supported by chest X-ray or CT scan, and can be confirmed by examination of a small piece of the affected tissue (called a biopsy).

Although smoking does not directly cause Mesothelioma, a combination of smoking and asbestos exposure has been proven to increase the risk of Mesothelioma occurring in the lungs. Mesothelioma is usually caused by the asbestos poisoning effects when breathing in asbestos dust such as at work or even when washing the clothes of someone who has worked with asbestos.

Most people don’t recover when they know they have the disease. The median survival time is about nine months, with a 5-year survival rate at only about ten percent. A few patients sometimes live for more than twenty years with the disease. While radiation treatment alone is not very effective, in combination with radical surgery and chemo-therapy, some patients can live more than five years.

Most patients die within 18 months of knowing they have this disease not because the disease is rapidly progressing, but because diagnosis is often only clear at a late stage of the disease. Treatment can be expensive, sometimes totaling up to around a million US dollars.

Litigation about this disease first initiated in 1929. More than five hundred thousand cases have gone to court so far. Those who build and repair ships have the greatest mortality rate from the disease. This is because asbestos is commonly used in ships. The amounts of money that claimants receive can be very large, which means that there are legal specialists who handle only mesothelioma claims.

The prognosis for the disease is typically not good, even given the currently available treatments.

Asbestos is a combination of six naturally occurring silicon based minerals which are combined in order to exploit the valuable characteristics of each. The material is made up of heat resistant crystals, which are thin and fibrous, are resistant to chemicals and have immense strength and flexibility.

The reason asbestos is hazardous is because inhaling the fibres can lead to severe health problems such as lung cancer, Asbestosis and Mesothelioma, illnesses which take anywhere between twenty and fifty years to develop.

Those at high risk are people working in jobs where their duties mean they must come into contact with the fibre, with the second most high risk group being those who live with anyone whose job causes them to come in to contact with asbestos fibres. In fact, around 80% of asbestos related illness cases are thought to be as a direct result of occupational exposure or exposure that is secondary.

Others are at risk because of the area where they live. Those who live near sites where it is likely to contain asbestos are also susceptible to asbestos related diseases. Sites such factories, power plants, refineries, shipyards or building demolition sites can often release asbestos fibres which then contaminate the surrounding air and are breathed in by those living in the area.

It goes without saying that one of the highest risk industries is asbestos product manufacturing, but industries which are high risk include automotive repair, due to the use of asbestos in brakes and clutches, oil refineries, construction, railroads, steel mills, shipyards and power plants.

This is not a definitive guide to all those who are likely to contract an asbestos related disease, but if you or a loved one have worked in any of these industries in the past, or lived in any of the areas mentioned then it is highly recommended that you are tested for mesothelioma and the other asbestos related illnesses.

Mesothelioma occurs most frequently in the area of tissue covering the lungs and is almost always caused by exposure to asbestos.

Asbestos related cancer usually takes until 20-50 years after the exposure to be diagnosed and due to the negative prognosis it has, in recent years there has been more and more research into alternative treatments which can be used to eradicate the disease from sufferers’ bodies or improve their quality of life.

Many of these alternative therapies are still in research and testing stages, but a growing number of those suffer ring with the disease are willing to take a chance and undergo treatment.

Vitamin C has been trialled as a cure at the Vale of Leven Hospital in Scotland and reportedly had ‘excellent results’. It was administered in quite high doses by the chief surgeon and was deemed successful, although in other studies have reported minimal or no success.

Iscador, a natural remedy, is the trading name of Viscum album, a particular species of mistletoe, , which has been said to reduce the effects of cancer. Very few experts suggest Viscum album reduces tumour size, but stimulation of the immune system, an improved in general health well being, and a reversion of cancerous cells into less damaging forms are some of its benefits.

Astragulus is another plant based remedy, which is a native Chinese plant which has been studied as a remedy in China. One such study concluded that if chemotherapy was combined with injections of Astragulus then the development of tumours could be inhibited and the function of the immune system could be improved.

No alternative therapies have been fully endorsed as of yet, but these advancements in the way we can treat and reduce the effects of asbestos cancer suggest that experts are getting closer to finding ways of increasing life expectancy in patients, or even finding a cure.

Occurring on the outside of the lungs, Mesothelioma is a form of cancer most common in those who have been exposed to asbestos, but which also occurs in those who have not come in contact with the material.

Mesothelial cells are cells which surround all our organs and it is in these that the Mesothelioma cancer occurs. There are three types of mesothlial cells, Epitheliod, Sacromatoid and Biphasic, and in cases of cancer one or more of these may be present in different combinations.

Epitheliod cells are the most common cancer cells of the three and account for between fifty and seventy percent of cells in malignant mesothelioma. This type of cell has a cubed shaped appearance and as a group they are arranged in a tubular, uniform arrangement.

This type of cell is often misdiagnosed as they have a similar appearance to adenocarinoma cells, although if the cells are inspected under a high power microscope then a proper diagnosis can be made.

Biphasic Mesothelioma cells are less common than epitheliod, but are not the least common type. They make up twenty to forty percent of mesothelioma cancer cells and are created as a combination between the other types of cell. The biphasic cells usually occur when the epitheliod and sacromatoid cells combine continuously through a tumour.

The third and final type are the, sacromatoid mesothelioma cells, which are the least common of the three, accounting for only 10-15% of mesothelioma cells. Sacromatoid cells have the shape of an irregular oval and the nucleus is not visible, characteristics shared by the more common sarcoma cells, meaning they are difficult to tell apart.

Whether only one cell type is present or a combination of more, the methods of treatment are very similar. There are traditional methods such as chemotherapy, surgery and radiation, and recently there has been further research in to less traditional methods, with a many suggesting these types of treatment will have more success.

Mesothelioma is a type of cancer that forms on the lining that protects the internal organs throughout the body. There are many factors that can lead to the disease and several diagnostic procedures that are used to detect it. The symptoms vary widely and will depend on many factors.

The form of cancer called mesothelioma can be found in the lining of any organ. However, the most typical type is that which is found around the lungs. This is usually a result of being exposed to such things as asbestos dust or even cigarette smoke. Over time malignant growths will occur in the sac surrounding the lungs and interfere with breathing.

The signs and symptoms

Many methods are put into place to detect this horrific disease. Although some of the symptoms are often hard to see, having a combination of them will be a good indication that the problem exists. Getting an early diagnosis is vital in successfully treating the disorder.

The initial step in treating any disorder is to be able to evaluate the signs of a problem. Some of the most common are breathing problems, blood filled sputum, and even a chronic feeling of fatigue. Each of these problems can be found in other disorders, but the combination of two or more could be an indication of the ailment.

Just like the symptoms, the diagnostics of this disorder will vary. It can often be detected by having a simple x-ray. Sometimes, it will be harder for the doctor to see and they might order such tests as a CAT scan. Once the disease is detected there is likely to be a biopsy.

Understand the treatment

There has been a lot of success in treating meosthelioma. However, when left undiagnosed the ailment will go into the latter stages and the odds in a positive outcome are greatly decreased. This is the reason that detecting the problem early is so vital.

Surgery is often the main forms of treatment. It has a fairly successful history in ridding the body of cancerous cells and most people tolerate the procedure well. The problem is that this form of treating the disease usually has to be followed by other therapies.

Once all cancer cells are removed then a regime of radiation therapy will usually be put into place. It is generally effective in removing any and all signs of thisdisease, but often has some very aggressive side effects. Chemotherapy will also usually be used during the time of radiation treatments. Chemo can also be used alone in some cases.

Mesothelioma has the potential of being a life threatening disease, but it does not have to be. By getting a diagnosis early on and implementing a treatment plan the effects will not be so devastating. Learn the symptoms and seek help from a medical professional at first sight of them. A few small actions might save your life.

If you are, you need to know your rights and consult with a mesothelioma cancer lawyer who can get you the restitution you both need and deserve. Mesothelioma is a devastating form of lung cancer caused by exposure to asbestos, and it has the power to destroy the lives of the patient and other family members. If you’re being faced with medical bills, emotional issues, and burning anger at a company that allowed this to happen to you, you aren’t alone. This has happened to hundreds of workers, and many are taking steps to seek the financial support they are entitled to.

Lawyers that specialize in mesothelioma cases are well-versed in all of the legal, emotional, and medical issues that you are facing, and they know how to get you the care and support you and your family are going to need. In addition, they will be able to provide you with the experienced legal counsel necessary to sort through the facts that are unique to your claim and get you the restitution that you deserve. It can be difficult to find an attorney who has the mesothelioma litigation experience to be able to help you; however, by doing some research and talking with others who have been through similar situations, you can find just the right person.

The blame for your condition does not fall on your shoulders. After all, when you worked in an environment where you were exposed to asbestos particles, you probably weren’t aware of the potential hazard they presented. A top mesothelioma cancer lawyer will tell you, however, that the company you worked for is totally to blame.

Companies using asbestos in their manufacturing processes have been aware of the devastating effects exposure could have on the health of their employees since as early as the 1920s. By the ’30s and ’40s, medical links between asbestos and cancer had been scientifically established, and companies were repeatedly warned that they should eliminate asbestos from their manufacturing processes in favor of the safer materials that were available.

Unfortunately for workers like you, companies chose to ignore the warnings in order to increase their bottom lines. Apparently ensuring employee health wasn’t as big of a priority as raising the profit margin. Their actions were highly-unethical, especially since they had the information and withheld it from the employees who innocently worked in their asbestos-filled environments. The suffering of mesothelioma patients could have been eliminated if only these companies had acted more responsibly. Since they chose not to, they are held liable for the devastating health problems being endured by employees.

What these companies did was nothing short of criminal, and our legal system has recognized this fact. With the right mesothelioma cancer lawyer you’ll be able to seek restitution for such things as lost wages, medical bills not covered by insurance, funeral expenses, and the cost of group support for family members. Although nothing can change what has already happened, a mesothelioma cancer lawyer can see to it that you receive the help you deserve to secure your family’s financial future.

It’s a disease that can remain dormant for as long as 20 to 50 years before it starts taking its devastating toll on a person’s health and life. Although the cancer may show up in less than 20 years in some cases, most people don’t develop any symptoms until somewhere around 35 years after exposure. Early symptoms may not ring any bells, either, because they may be as basic as general pain in the chest or back. Therefore, anyone who ever worked in an environment where there were asbestos fibers needs to be on guard for the rest of their lives.

In cases of Mesothelioma, cancer cells can develop in the lining surrounding the lungs, inside the ribcage, and around the organs in the abdomen. It’s possible that even limited exposure to asbestos, like in the home, could result in Mesothelioma, but usually people who were exposed for longer periods of time are more susceptible. You may not even realize that you were exposed. A lot of employers back then withheld the information about asbestos exposure from their employees. For example, if you worked in construction one summer, you might have been exposed. It’s also very common for people who were in the Navy prior to the mid 70s to develop Mesothelioma.

Maybe you’re wondering what materials you may have been exposed to contain asbestos. After all, it was a pretty common material up until the 1970s when people started realizing the health implications it could have. Prior to that time, most insulation materials contained asbestos, including insulations for pipes, fire-proofing, and boilers. In addition, plasters, joint compounds, and cements that came in powdered form and were intended for insulation purposes also contained asbestos. These are particularly lethal in that using them meant breathing in a lot of dust.

People who worked in the following occupations prior to the mid 1970s need to be alert for the symptoms of Mesothelioma: * Paper mills * Brake and clutch shoe manufacture * Boilermakers * Electrical and carpentry workers or bricklayers * Insulation – manufacture or installation * Steel refineries and other steel industries * Shipyard workers * Maintenance workers

Even if you know you worked in one of these industries and could have been exposed to asbestos, there’s no need to panic. Since this exposure will place you at a higher risk for Mesothelioma, however, you’ll want to make sure your doctor knows all the specifics. He may even want to run some tests just to make sure that you aren’t showing any signs of the disease. Most likely he will want to do a complete physical if you haven’t had one lately and have some x-rays taken of your chest and abdominal area. He might want you to take pulmonary function tests, a CT scan, or an MRI. If you show no symptoms, then you’re clear for now, but you’ll have to keep watch for the development of the condition all the rest of your life.

If you should happen to be diagnosed with Mesothelioma sometime in the future, you’ll want to hire a lawyer who specializes in this type of litigation to file a claim against your employer. You may be eligible for restitution if it can be proven that your employer was in any way negligent in providing you with information or safety equipment that could have prevented your illness.

You’re facing financial problems, and you may not want to take on the additional expense of hiring a Mesothelioma lawyer. You may be operating under the misguided belief that you won’t be able to prove the company was to blame for your situation or that it’s been far too long since you were originally exposed. Unfortunately, by thinking this way you could be giving up your rights to compensation should be coming to you. In fact, hiring a lawyer to help you with your case if probably the best possible thing for you to do.

1. You are nothing but a victim of your employer’s negligence. As early as the 1920s companies had access to information telling them that they were risking your health by having asbestos in the workplace. By the ’40s they were receiving warnings about the health risks and being advised to eliminate asbestos from their manufacturing processes. They chose not to listen, because to listen would mean lower profits. Therefore, they knowingly chose the money over your health. Why shouldn’t you hire a Mesothelioma lawyer who will help place the responsibility for your exposure back where it belongs?

2. Mesothelioma may have taken the life of a loved one and left you with insurmountable debts. An experienced Mesothelioma lawyer will be able to file a wrongful death suit in behalf of your loved one which will bring you a settlement to compensate you for the expenses you’ve inherited as well as for your emotional suffering brought about by this person’s death.

3. It’s possible that since you’ve been diagnosed with Mesothelioma you’ve been watching the depletion of your life’s savings, seeing a possible foreclosure looming on the horizon, and trying to live on little of nothing. You don’t have to worry about a Mesothelioma lawyer costing you money you don’t have. The way most of these lawyers work is on a no win, no pay basis. Therefore, unless they will a settlement for you, you won’t have to pay them anything.

4. Corporate negligence in the workplace has been a problem for far too long. Everything is about the bottom line, and companies were willing to sacrifice the health of their employees in order to make more money. This is something that should never have been stood for, and now too many people are being forced to live with the consequences of this poor, faulty decision-making. Most Mesothelioma lawyers will ask for punitive damages that not only punish the company you worked for because of their inattention to your health but which will also serve as a warning to all of corporate America that their behavior won’t be tolerated any longer.

When you hire a Mesothelioma lawyer and present your case to the world, you end up helping yourself, your family, and workers everywhere.

It is usually caused by asbestos exposure.

While smoking does not itself cause the disease, when combined with asbestos exposure it has been shown to increase the risk of this disease being contracted in the lung area. Mesothelioma is sometimes called “asbestos poisoning” because that is how it is caused. The exposure can be either direct exposure to asbestos dust, or indirect such as when washing clothes of a person who works with this chemical.

Recovery from the disease is not common, and median survival times is about 9 months from presentation (with the 5-year survival rate being about 10%), although a few people do survive for more than 20 years after having the disease. Some patients have survived more than 5 years after having radical surgery plus chemo and radiation therapy, but radiation therapy alone has proved ineffective.

Most people who get the disease are dead within 18 months from knowing they have it. This is due to the challenges in having a clear diagnosis rather than the progression rate of the disease. Treatment for the disease can sometimes total 800,000 dollars.

Legal action about the disease started in 1929 and more than five hundred thousand claims have been filed so far. The highest mortality rate from the disease is in the ship-building and repairing industries, because of the extensive use of asbestos on ships. There are specialist attorneys and lawyers who handle legal action. The amounts received from a claim can be considerable.

The prognosis for the disease is typically not good, even given the currently available treatments.
